Background

Eugene native Shay Scott received his J.D. from the University of Oregon in 1993, where he also served as Executive Editor for the Oregon Law Review.  He has practiced with the firm for 18 years in a wide variety of areas. Admitted as an attorney in Washington, Oregon, and multiple federal courts, Mr. Scott is a key attorney in the firm's antitrust and class action litigation.

Mr. Scott has a broad general practice and handles state and federal appeals and an extensive range of civil and commercial litigation.  Mr. Scott also enjoys working with local business clients and assisting them with all of their business law needs, from business formation, employment matters and lease negotiations, to buy-sell agreements and more complex business issues and resolving disputes. Mr. Scott is also experienced in real estate and foreclosure law, public natural resources law, maritime law, estate planning, personal injury law, and entertainment law. He strives to keep things simple, he listens to his clients, and he truly enjoys helping people achieve their goals.

Prior to law school, in 1987 Mr. Scott earned a B.M. in Music Theory and Composition from Arizona State University with an emphasis on piano. He has built and operated several recording studios, published a wide variety of original music, and he continues to produce music and counsel music professionals, bands, artists, and creative firms.

Representative Work

Tubra v. International Church of the Foursquare Gospel. Succeeded in reinstating substantial jury verdict in landmark First Amendment case involving church's defamation of former pastor, and protected verdict on appeal to the U.S. Supreme Court.


Guhlke v. Cook. Prevailed at trial in complex action to unwind series of fraudulent transfers of real property in Washington, which were made by defendant to defraud creditors and avoid paying client's money judgments.


Weyerhaeuser antitrust litigation. Integral part of litigation team that secured largest antitrust verdict in the history of the Pacific Northwest against Weyerhaeuser, as well as large antitrust settlements in subsequent cases.


Antitrust class action litigation. Integral part of litigation team currently pursuing two separate antitrust class actions in the LCD flat panel market, and four West Coast seafood input markets.


White v. Praestantia. Successfully defended anesthesia group through final judgment dismissing $1 million employment discrimination claims in federal court.


American Forest Resource Council. Represented nonprofit corporation and its members in public lands and environmental cases in Oregon, Washington, and northern California regarding land management decisions.


Published Work

Co-authored Chapter 1 of “Foreclosing Security Interests” published by the Oregon State Bar in 1997, as well as the 2001 supplement.


Co-authored, “Torts,” Chapter 24 Supplement in 2000, also published by the Oregon State Bar.


Two of his law review articles regarding federal jurisdiction and environmental claims have been published.


Community Involvement

Mr. Scott contributes pro bono services to elderly citizens and children.
